Carbly Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Carbly (operated by the developer registered on the Apple App Store as nahuelcpdev) governing your use of the Carbly iOS application ("the App") and any services accessed through it.

Please read these Terms carefully. By downloading, installing, or using the App, you agree to them. If you do not agree, do not install or use the App.

Subject to your compliance with these Terms, Carbly grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and run the App on any Apple-branded device that you own or control, strictly for personal and non-commercial use. The scope of this license also conforms to the Apple Media Services Terms and Conditions and the "Licensed Application End User License Agreement" (the "Standard EULA") that Apple publishes at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Where these Terms differ from the Standard EULA, these Terms control to the extent permitted by the Standard EULA.

All rights not expressly granted in these Terms are reserved to Carbly.


3. Accounts

The App creates an anonymous account on first launch. That anonymous account, together with a session token held in the iOS Keychain, authenticates you across App launches. You are responsible for maintaining the security of any device on which the App is installed while you remain signed in.

You may delete the account at any time from Settings → Account → Delete Account. The Privacy Policy describes the data lifecycle on deletion; the contractual effect is set out in section 10 ("Termination") below.


4. Subscriptions (Carbly Premium)

The App offers an optional auto-renewable subscription called Carbly Premium that unlocks additional features. This section is written to satisfy Apple App Store Review Guideline 3.1.2.

4.1 What the subscription includes

Carbly Premium includes: high-volume AI food scans (the free-tier daily cap is removed and generous monthly fair-use limits apply), full searchable meal history, advanced fasting insights, per-goal daily electrolyte targets, and any additional features designated as Premium in the App at the time of your purchase. "Fair-use" means the App may rate-limit or require a brief cooldown on individual scan or chat requests to prevent abuse; the in-App paywall at the time of your purchase is the authoritative description of what is delivered for that subscription period.

4.2 Subscription plans, length, and price

Carbly Premium is offered in three plans:

The exact price for each plan is localized to your App Store region and displayed on the in-App paywall by StoreKit at the time of purchase. Because pricing is region-specific and can change, the paywall display at the time of your purchase is the authoritative price. We do not publish hardcoded prices in these Terms.

4.3 Free trial (when offered)

Where a free trial is offered for a plan, its length is shown on the in-App paywall. Only users who have not previously consumed a trial for the same subscription are eligible, as determined by Apple StoreKit; ineligible users see a "Subscribe" button instead of a "Start Free Trial" button. If you cancel before the trial ends, you will not be charged. If you do not cancel before the trial ends, your subscription will convert to a paid subscription at the price shown on the paywall.

4.4 Apple-required disclosures (verbatim where applicable)

4.5 How to cancel

You cancel your subscription through iOS, not through the App:

  1. Open the iOS Settings app.
  2. Tap your Apple ID at the top.
  3. Tap Subscriptions.
  4. Select Carbly Premium.
  5. Tap Cancel Subscription.

Alternatively, from inside the App, go to Settings → Manage Subscription; this opens the same iOS-native management sheet. Cancellation takes effect at the end of the current billing period; you retain Premium access until then.

4.6 Refunds

Refunds for auto-renewable subscriptions are handled by Apple under the Apple Media Services Terms and Conditions. Requests are submitted at https://reportaproblem.apple.com. Carbly does not process refunds directly.

4.7 Price changes

If we change the renewal price of a plan, Apple will notify you through the Apple ID account and, where required by applicable law, ask you to consent to the new price before the next renewal. Without affirmative consent where required, the renewal at the new price does not proceed.

6. AI output, nutritional information, and health disclaimer

Carbly is a wellness tracker, not a medical app or a medical device. Nothing in the App is a diagnosis, prognosis, treatment, or cure of any condition.

Fasting is not appropriate for everyone. If you are pregnant or breastfeeding, under 18, diabetic or using glucose-lowering medication, have a history of disordered eating, or have any medical condition that requires regular meals, you should not use the fasting feature without guidance from a healthcare provider. If you are in crisis or struggling with food or your body, support is available from the National Eating Disorders Association at 1-800-931-2237 or at https://www.nationaleatingdisorders.org/help-support.


7. Third-party services

The App uses third-party services to deliver its functionality, including Apple (App Store, StoreKit, Speech framework) and sub-processors covering backend infrastructure, AI inference, subscription management, product analytics, and crash and performance reporting. The Privacy Policy describes what category of data flows to each kind of provider and why. Your use of the App is, in relevant part, also governed by each provider's terms. Carbly is not responsible for the acts or omissions of a third-party provider outside our reasonable control.


8. Intellectual property

The App, the Carbly name and logo, the in-App design, and all copy, artwork, code, and documentation are owned by Carbly or licensed to Carbly. You receive only the license described in section 2. All other rights, title, and interest remain with Carbly and its licensors.

You retain ownership of data you submit through the App (food photos before they are discarded, voice transcripts, food log entries, profile inputs). You grant Carbly a limited, worldwide, non-exclusive, royalty-free license to use that data only to operate the App for you — for example, to send a food photo to the AI provider to return a scan result, or to persist your food logs so they appear on the dashboard. This license ends when the underlying data is deleted.


9. Disclaimers

To the fullest extent permitted by applicable law, the App is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment.

Without limiting the above, Carbly does not warrant that:

Some jurisdictions do not allow the exclusion of certain warranties. To the extent an applicable warranty cannot be excluded, it is limited to the shortest duration and smallest scope allowed under the applicable law.


10. Limitation of liability

To the fullest extent permitted by applicable law, Carbly, its officers, employees, and sub-processors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with your use of the App, including loss of profits, loss of data, loss of goodwill, business interruption, or personal injury, even if Carbly has been advised of the possibility of such damages.

In no event will Carbly's aggregate liability exceed the greater of:

Some jurisdictions do not allow limitations on implied warranties or the exclusion of certain damages. To the extent a limitation in this section cannot be enforced, it is limited to the minimum permitted by the applicable law, and the remaining limitations continue to apply.

Nothing in these Terms excludes or limits liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot be excluded or limited under applicable law.


11. Termination

11.1 Termination by you

You may terminate these Terms at any time by uninstalling the App. You may additionally delete your account by going to Settings → Account → Delete Account inside the App. Deletion removes your data as described in the Privacy Policy.

We may suspend or terminate your access to the App if:

Termination ends the license in section 2. Sections that by their nature are intended to survive termination — including sections 6 (health disclaimer), 8 (intellectual property), 9 (disclaimers), 10 (limitation of liability), 12 (governing law), and 13 (general) — survive termination. Account deletion rights under the Privacy Policy are not affected by termination.


12. Governing law and disputes

These Terms and any dispute arising out of or relating to them are governed by the laws of England and Wales, without regard to conflict-of-laws rules. The courts of England and Wales will have non-exclusive jurisdiction over any dispute.

Nothing in this section limits your right as a consumer to bring a claim in the courts of your place of residence or to rely on mandatory consumer-protection rules of your place of residence that cannot be derogated from by contract.

13. General

13.1 Entire agreement

These Terms, together with the Privacy Policy and any plan-specific terms displayed on the in-App paywall at the time of your purchase, form the entire agreement between you and Carbly regarding the App and supersede any prior agreements.

13.2 Changes to these Terms

We may update these Terms to reflect changes to the App, the legal environment, or our business practices. When we make a material change:

Continuing to use the App after a change takes effect indicates acceptance of the updated Terms. If you do not agree, stop using the App and, if you wish, delete your account.

13.3 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.

13.4 Waiver

A failure to enforce any provision is not a waiver of that or any other provision.

13.5 Assignment

You may not assign these Terms. We may assign these Terms to a successor in connection with a merger, acquisition, or sale of assets, subject to applicable law.

13.6 Apple as third-party beneficiary

You acknowledge that Apple is a third-party beneficiary of the Standard EULA as it applies to the App and, as such, Apple has the right to enforce those terms against you.

13.7 Relationship to Privacy Policy

Privacy practices are governed by the Carbly Privacy Policy, published at https://carbly.pro/privacy. Where these Terms and the Privacy Policy address the same topic (for example, account deletion), read them together; the Privacy Policy controls as to descriptions of data processing, and these Terms control as to contractual rights and obligations.
